Impact Fitness Club Communications Waiver and Digital Guest Registry

Communications Waiver

1. Purpose This Communications Waiver (“Waiver”) is intended to acknowledge and grant permission for the collection, use, and dissemination of communications for the specified purposes outlined below.

2. Parties Involved This Waiver is entered into by and between:

  • Disclosing Party: [Full Name of Member]
  • Receiving Party: Impact Fitness

3. Scope of Communications This Waiver applies to the following types of communications:

  • Written (emails, letters, text messages, etc.)
  • Verbal (phone calls, in-person conversations, recorded discussions, etc.)
  • Digital (social media messages, online chats, virtual meeting recordings, etc.)

4. Consent to Use The Disclosing Party consents to the following uses of the communications:

  • Collection: Receiving Party may collect communications for documentation purposes.
  • Use: Communications may be used for [marketing, training, dispute resolution, etc.].
  • Dissemination: Communications may be shared with [specific groups, e.g., internal teams, third parties, etc.].

5. Restrictions The Receiving Party agrees to the following limitations:

  • Communications shall not be used for purposes outside the specified scope without additional written consent.
  • Personal or sensitive information shall be redacted or anonymized unless otherwise authorized.
  • Communications shall not be altered or misrepresented.

6. Duration This Waiver remains in effect indefinitely:

  • Revoked in writing by the Disclosing Party.

7. Confidentiality The Receiving Party agrees to maintain the confidentiality of any sensitive information contained in the communications, except as expressly permitted by this Waiver or required by law.

8. Indemnification The Receiving Party agrees to indemnify and hold harmless the Disclosing Party against any claims arising from the unauthorized use or dissemination of communications.

9. Governing Law This Waiver shall be governed by and construed in accordance with the laws of Massachusetts.

10. Acknowledgment By signing below, the Disclosing Party acknowledges that they have read, understood, and agreed to the terms of this Communications Waiver.

Overview of Communication Waiver: Member affirms, acknowledges and attests that Member’s mailing address, telephone number, cellular telephone number, and e-mail address provided to Impact Fitness are accurate and were provided by Member voluntarily. Subject to applicable law, Member agrees that Impact Fitness, including its agents and affiliates, may contact Member at any mailing address, phone number or e-mail address provided by Member to Impact Fitness. I understand that I may receive information, promotions, appointment reminders & alerts from Impact Fitness via SMS (short message service) text messages. I understand this program is completely voluntary and that text messaging rates & fees may apply as determined by my cellular provider. Impact Fitness is in no way responsible for any fees charged to me by my cellular provider. If at any time I wish to discontinue receiving text messages from Impact Fitness can reply STOP to any message. The Member agrees and acknowledges that he/she has carefully read this waiver and release, and fully understands it is a release of liability.

Digital Guest Registry

1. Purpose This Digital Guest Registry (“Registry”) is designed to document and manage the attendance of guests in a digital format while ensuring compliance with applicable privacy and data protection regulations.

2. Information Collected The following information will be collected from guests:

  • Full Name
  • Contact Information (phone number, email address, etc.)
  • Personal Information (DOB, gender, race, emergency contact, etc.)
  • Date and Time of Visit
  • Purpose of Visit

3. Use of Information The information collected in the Registry will be used for the following purposes:

  • Verification of guest attendance.
  • Emergency contact purposes.
  • Compliance with safety or legal requirements.

4. Data Storage and Retention

  • Guest information will be stored securely in a digital format.

5. Access and Sharing

  • Access to the Registry will be limited to authorized personnel only.
  • Guest information will not be shared with third parties without prior consent, except as required by law.

6. Guest Acknowledgment By signing or submitting information electronically, the guest acknowledges:

  • They have provided accurate information.
  • They understand and agree to the purpose and use of the data as outlined.
